Agreement to Terms

By accessing or using Thru (the “Service”), including our mobile application and website, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service.

Account Registration

To access certain features of the Service, you may be required to create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials and not share your password
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized access or security breach

User Content

Your Content

You retain ownership of all content you create, upload, or share through the Service (“User Content”), including journal entries, photos, comments, and gear lists.

License Grant

By posting User Content, you grant Thru a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the Service. This license ends when you delete your User Content or account.

Content Responsibility

You are solely responsible for your User Content and the consequences of posting it. You represent and warrant that:

  • You own or have the necessary rights to use and authorize the use of your User Content
  • Your User Content does not infringe any third party's intellectual property or privacy rights
  • Your User Content complies with these Terms and all applicable laws

Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Post content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Impersonate any person or entity or falsely state your affiliation
  • Post false or misleading trail conditions that could endanger other hikers
  • Spam, advertise, or solicit without authorization
  • Interfere with or disrupt the Service or servers connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service
  • Collect or harvest user data without consent
  • Use automated systems (bots, scrapers) without our written permission

Health Data Disclaimer

Important: Thru is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

  • Health data displayed in the app is for informational purposes only
  • Data accuracy depends on your connected devices and may not be 100% accurate
  • Always consult a healthcare professional for medical advice
  • Do not rely on the app for emergency situations or medical decisions

Trail Safety Disclaimer

Important: Thru provides user-generated trail information for general guidance only.

  • Trail conditions change rapidly and information may be outdated
  • Always verify trail conditions with official sources (land management agencies, trail associations)
  • User-reported conditions (water sources, hazards, closures) are not guaranteed to be accurate
  • You are solely responsible for your safety on the trail
  • Thru is not liable for any injuries, damages, or losses resulting from reliance on trail information

Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Thru and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or included software, nor may you reverse engineer or attempt to extract the source code.

Third-Party Services

The Service may integrate with third-party services (Apple Health, Google Fit, Garmin Connect). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. You may also delete your account at any time through the app settings. We will retain certain data as required by law or for legitimate business purposes.

Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THRU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE, ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, OR UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

Indemnification

You agree to defend, indemnify, and hold harmless Thru and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in [Your State], and the arbitrator's decision shall be final and binding.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Thru.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
